About NobleVerge
NobleVerge is a North Carolina-based startup developing a digital platform designed to help adults aged 50 and older discover local businesses, discounts, savings opportunities, activities, and community resources.
NobleVerge is currently in the prelaunch and development stage. The app is not yet available to the public.
These Terms of Use explain the conditions for accessing and using our current informational website, https://nobleverge.com, including submitting consumer or business interest forms.
1. Acceptance
By using the website, you agree to these Terms to the extent an enforceable agreement is formed under applicable law. Business applicants are asked to affirmatively agree to these Terms when submitting an application. If you disagree, do not use the site or submit an application.
2. North Carolina service area and early stage
NobleVerge is being developed exclusively for North Carolina, with plans to serve all 100 counties and adults ages 50 and older. Participating businesses, discounts, events, and resources may not be available in every county. NobleVerge is in an early-development stage; features and availability may change.
3. Independent businesses and offers
Listed or applying businesses are independent third parties. Businesses—not NobleVerge—set their own prices, eligibility ages, senior discount requirements, restrictions, expiration dates, and availability, and are responsible for honoring valid offers and providing their products and services. Not every business offers a senior discount. Offers may start at age 50, 55, 60, 65, or another age. Verify details directly with the business before relying on an offer or traveling.
4. Information and listings
Website content and business-submitted information are for general informational purposes. NobleVerge may review submissions but does not guarantee the completeness, accuracy, safety, availability, or timeliness of independent third-party listings, offers, or activities. Listing a business does not automatically mean NobleVerge endorses or guarantees it.
5. Early access
Early-access registration does not guarantee a launch date, listing, discount, benefit, or feature. Email communications and opt-out choices are described in our Privacy Policy.
6. Business applications and advertising
North Carolina businesses may apply for consideration. There is currently no charge to submit an application. Applications are not automatically approved or published, and NobleVerge may request verification, edits, or additional details, or decline or remove a listing for legitimate operational, accuracy, safety, or legal reasons. We may offer paid advertising later, but no fees arise merely from a free application. Any paid services will require separately disclosed terms and affirmative agreement.
7. Business applicant promises
By applying, you represent that you are authorized to act for the business; your submitted information is accurate to the best of your knowledge; advertised offers are genuine and lawful; you have rights to submit your materials; and you will notify NobleVerge of material changes. You remain responsible for your own goods, services, offers, and legal compliance.
8. Permission to use business materials
If a business provides a name, logo, description, or other promotional material for a potential listing, it grants NobleVerge a nonexclusive, royalty-free license to review, format, reproduce, and display that material in connection with an approved listing and promotion of that listing. This license applies only to material the applicant is authorized to provide and ends following a valid withdrawal request, subject to reasonable removal timelines and lawful archival needs. Applicants retain ownership of their materials.
9. Acceptable use
You may not impersonate others; submit misleading or unlawful content; violate intellectual property or privacy rights; harvest personal information; introduce malicious code; or interfere with the website's operation or security.
10. Intellectual property
NobleVerge's original site content, design, and branding belong to NobleVerge or are used with permission. Business names and logos belong to their respective owners. You may not commercially reuse proprietary site materials without authorization except as permitted by law.
11. Independent transactions
Transactions, appointments, events, and purchases with third-party businesses are between you and those businesses unless NobleVerge expressly states otherwise. NobleVerge is not responsible for an independent business's performance or conduct to the extent permitted by law.
12. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND INFORMATIONAL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not promise uninterrupted service, error-free operation, or availability of any particular offer. This clause does not waive rights that cannot lawfully be waived.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NOBLEVERGE AND THE WEBSITE OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE WEBSITE OR INDEPENDENT THIRD-PARTY OFFERS. For claims arising solely from NobleVerge's free informational website services, aggregate liability is limited to the greater of $100 or amounts the claimant paid directly to NobleVerge for the relevant service in the preceding 12 months, to the extent legally enforceable. These limitations do not apply where prohibited by law and do not eliminate liability for conduct that cannot lawfully be excluded.
14. Business applicant indemnification
To the extent permitted by law, a business applicant agrees to defend and indemnify NobleVerge and its website operator against third-party claims, damages, and reasonable costs arising from the applicant's materially false information, unlawful business conduct, infringement of third-party rights, or material breach of these Terms, except to the extent caused by NobleVerge's own unlawful conduct or where prohibited by law.
15. Privacy
Our Privacy Policy describes how we handle information. We do not sell personal information or provide private subscriber lists to participating businesses without specific permission.
16. Changes and availability
We may modify or discontinue features and update these Terms. Updated Terms will be posted with an effective date. Material changes to existing contractual rights will be handled as required by law.
17. North Carolina law and disputes
To the extent permitted by law, these Terms are governed by North Carolina law. Subject to applicable mandatory rules, disputes will be brought in a court of competent jurisdiction in North Carolina. Nothing in these Terms waives nonwaivable legal or consumer rights.
18. Severability
If a provision is unenforceable, the remaining provisions continue to the extent permitted by law.
